Terms of Use for LearnReader

These Terms of Use ("Terms") govern your use of the LearnReader mobile application and related services (collectively, the "Service"). By downloading, accessing, purchasing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be legally capable of entering into these Terms. If you have not reached the age of legal majority where you live, your parent or legal guardian must review and accept these Terms on your behalf.

You can use LearnReader and purchase subscriptions without creating a personal account. Sign in with Apple is optional and is used for account-based features, such as syncing supported learning data across devices. If you use Sign in with Apple, you are responsible for maintaining the security of your Apple account and for activity performed through your LearnReader account. Information provided through your account must be accurate. Notify us promptly at learnreader@proton.me if you believe your account has been accessed without authorization.

2. The Service

LearnReader provides language-learning tools that may include:

Features, limits, supported languages, and availability may change over time. The current product description and purchase screen controls if they differ from a general description in these Terms.

3. AI-Generated Content

Some translations, explanations, pronunciations, and learning suggestions are generated using artificial intelligence. AI output may be inaccurate, incomplete, offensive, outdated, or unsuitable for a particular context. You must review important output independently and must not rely on LearnReader as a substitute for professional, medical, legal, financial, safety-critical, or certified translation advice.

Do not submit confidential, sensitive, regulated, or third-party personal information for AI translation unless you have the right and a lawful basis to do so.

4. User Content and Third-Party Content

You retain any rights you have in content you import, select, save, or submit. You grant us a limited, worldwide, non-exclusive license to host, process, transmit, reproduce, and format that content only as needed to operate, secure, and improve the Service.

You represent that you have the necessary rights to use content with LearnReader. You may not use the Service to infringe copyrights, privacy rights, contractual restrictions, or other rights. LearnReader does not provide books, videos, websites, or manga merely because the Service can open or interact with them, and we do not endorse or control third-party content or websites.

5. Subscriptions, Billing, and Trials

LearnReader may offer auto-renewable subscriptions through Apple's In-App Purchase system. The purchase screen displays the subscription name, duration, included service, price, billing period, and any trial or introductory offer before you confirm a purchase. Sign in with Apple is not required before purchasing an App Store subscription, but you may sign in later if you want to use account-based synchronization features. Subscription access is intended to be available on supported devices associated with your Apple Account through Apple's purchase and restore systems.

We may change subscription offerings or prices prospectively. Apple will provide any notice or consent flow required for a price increase. Changes do not affect a period already paid for.

If your subscription ends or premium access is otherwise no longer active, premium limits may revert to free limits. Existing synchronized flashcards are not deleted solely because your subscription ends, but creating or synchronizing additional cloud flashcards may be limited until your account is within the free limit or premium access is restored.

Subscription availability, trials, introductory offers, restore behavior, refunds, and billing are subject to Apple's App Store rules and systems. If Apple reports that a subscription is inactive, expired, refunded, revoked, or otherwise unavailable, premium access may be suspended or adjusted accordingly.

The Service, including its software, design, branding, and original content, is owned by LearnReader or its licensors and is protected by applicable intellectual property laws. These Terms grant you only a personal, limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms and the App Store Usage Rules.

The Service may include third-party and open-source software components. Those components remain subject to their own license terms and notices, which are available in our Open-Source Notices. Nothing in these Terms limits rights you may have under an applicable open-source license.

Our Privacy Policy explains how information is collected, used, shared, and retained. It is incorporated into these Terms by reference.

9. Account Deletion and Termination

If you use Sign in with Apple, you may initiate account deletion from Settings > Account > Delete Account. Account deletion does not cancel an Apple subscription; cancellation must be completed in Apple subscription settings.

You may stop using the Service at any time. We may suspend or terminate access if you materially or repeatedly violate these Terms, create security or legal risk, misuse the Service, or if we are required to do so by law. Where reasonable, we will provide notice and an opportunity to address the issue. Provisions that by their nature should survive termination will remain effective.

10. Changes and Availability

We may update, add, limit, suspend, or discontinue features to improve or secure the Service, comply with law, or reflect technical and business changes. We do not guarantee that every feature will always be available, uninterrupted, or supported on every device, language, or location.

We may update these Terms. The updated Terms will be posted at this URL with a revised effective date. Where required, we will provide additional notice or request consent. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR AI OUTPUT WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot be excluded under applicable law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEARNREADER AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE.

OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR USD 50. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

13. Apple-Specific Terms

If you obtained LearnReader through Apple's App Store, Apple is not a party to these Terms and is not responsible for the Service, maintenance, support, warranties, or claims relating to LearnReader. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.

Unless a custom end-user license agreement is presented in App Store Connect, your license to the app is also subject to Apple's Standard Licensed Application End User License Agreement. If these Terms conflict with Apple's mandatory App Store terms, those mandatory terms control for your use of the iOS app.

14. Governing Law

These Terms are governed by the laws of Kazakhstan, without regard to conflict-of-law rules. This choice does not deprive you of mandatory protections or rights available under the laws of your country of residence. Any dispute forum requirement applies only to the extent permitted by applicable law.

15. General Terms

If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, reorganization, or transfer of the Service, subject to applicable law. These Terms, the Privacy Policy, and applicable Apple terms form the agreement concerning your use of the Service.
